Formal Grievance Process
- Supportive measures will be given to both complainant and respondent
- Formal resolution designated by the Title IX Coordinator to address conduct regarding Title IX regulations (34 CFR §106.45).
- A reasonably prompt time frame for filing and resolving appeals, and completing informal resolution processes; AND
- Any delay of the grievance process or a limited extension of time frames for good cause, both complainant and respondent will be given written notice of the delay or extension and reasons for the action
- Upon receipt of a formal complaint indicating that the complainant wants a formal investigation, written notice is given to both parties regarding the grievance process, the allegations of sexual harassment under penal code 106.30, the identities of both parties involved, the date/time/location of incident, and
- Presumption that the respondent is not responsible for the alleged conduct and that a determination regarding responsibility is made at the conclusion of the grievance process based on a preponderance of evidence
- The Title IX Coordinator or assigned investigator will investigate the claim of sexual harassment and write a report that summarizes any findings based on collected evidence;
- Prior to the completion of the investigative report, both parties will be given 10 days to review the report. Each party will be able to submit a meaningful written response, which the Title IX Coordinator or investigator will consider prior to the completion of the report
- The report is then finalized and fairly summarizes relevant evidence. At least 10 days prior to a hearing (if a hearing is applicable) or a determination regarding responsibility, the final report is submitted to the complainant and respondent as well as each party’s advisor.
