DACA & Other Executive Actions

We understand that results of the 2016 presidential election brought up many concerns for our undocumented population and has left many students with uncertainty around our transition as a nation.

Deferred Action for Childhood Arrivals

The most high-profile executive action President-elect Donald Trump has pledged to repeal is Deferred Action for Childhood Arrivals (DACA), which has given thousands of young people access to work permits and relief from deportation.

DACA can be rescinded by a new administration.

  • If DACA is repealed, recipients of DACA will lose the ability to legally work in the United States.
  • A Trump administration could require that DACA recipient return their work permits or be subject to further enforcement action.

Applying to DACA for the first time can be risky.

It is difficult to assess what is to be expected as the Trump Administration takes office.

New applicants run the risk of

  1. losing $465 (set to increase to $495 on December 23, 2016)
  2. storing their information in databases that could potentially be available to the Trump administration, who may then deny the application, and issue a “Notice to Appear” in removal proceedings against everyone who is denied DACA.

It is strongly recommended against submitting an initial application at this time.

DACA Renewals

  • If you already have DACA and are considering whether to renew it, immigration authorities already have the information on your original application, so there is less risk in submitting the renewal application.
  • It is currently taking USCIS about 120 days to approve DACA renewals.  Although USCIS could speed up their processing, it is possible that your DACA renewal will not be approved before January 20.

Traveling Abroad

  • If you applied for or have received advance parole (permission from U.S. Citizenship and Immigration Services to return to the U.S. after traveling abroad), be sure to return to the U.S. before January 20, 2017.
  • It may be harder to return to the U.S. after that date if the law changes, and there is no certainty that you will be able to return on or after that date.
